Limited Warranty Statement
IIMPORTANT: THIS LIMITED WARRANTY CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
1. Limited Warranty
RYSE Inc. (“RYSE”) warrants this RYSE Gear window shade motorization product and accessories (“Product”) contained in the original packaging against defects in materials and workmanship when used normally in accordance with RYSE’ technical specifications and user manual for a period of one (1) year from the date of original retail purchase by the end-user or purchaser (“Warranty Period”).
2. Return and Warranty Process
To obtain warranty service, you must first obtain a Return Merchandise Authorization (RMA) number from a Customer Support Representative (CSR) at RYSE. Customer Support contact information can be found by visiting www.helloryse.com. RYSE may attempt to troubleshoot a warranty-related problem prior to issuing a RMA number, and the customer will be required to cooperate with RYSE in this regard. RYSE may ask for additional information upon request. Issued RMA numbers remain valid for a period of thirty (30) days from issuance. Once an RMA number is obtained, your Product must be shipped freight prepaid; together with proof of purchase and all accessories, either in its original packaging or packaging affording an equal degree of protection, to the RYSE authorized distribution facility identified by the CSR. Failure to return any of the accessories may result in a delay and/or result in a credit to RYSE or an invoice for the missing accessories.
If during this Warranty Period a defect arises and you submit a valid claim to RYSE and follow the instructions for returning the Product, we will, at our option, either (i) repair the Product using either new or refurbished parts, (ii) replace the Product with a new or refurbished Product, or (iii) refund the purchase price of the Product. A replacement Product assumes the remaining warranty period of the original Product or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a Product is exchanged, any replacement item becomes your property and the replaced item becomes RYSE’ property. When a refund is given, the Product for which the refund is provided must be returned to RYSE and becomes RYSE’ property.
You will reimburse RYSE for the inspection, testing and repair of returned Product determined by RYSE not to be defective or which falls under one of the warranty exclusions described below (as well as pay all shipping and handling charges). In all cases, RYSE’ determination as to whether or not the Product is defective and covered by warranty will be final.
3. Scope of and Limitation Warranty
RYSE’ only obligation shall be to repair, replace or refund the defective Product which does not conform to the Limited Warranty. RYSE shall not be liable for any injury, loss or damage, direct or consequential, arising out of, or the inability to use, the Product. Before using, the end-user and/or the purchaser shall determine the suitability of the Product for its intended use, and assumes all risks and liability in connection therewith.
This Limited Warranty does not apply to: (i) damage caused by usage, setup or installation not in accordance with installation and operating instructions; (ii) damage caused by misuse, accident (including, without limitation, collision, fire and the spillage of food or liquid), neglect, abuse, alteration, unusual stress (including, without limitation, use in improper temperature, humidity, or other environmental conditions), modification, improper or unauthorized repair, testing or improper storage; (iii) cosmetic damage including but not limited to scratches or dents; (iv) normal wear and tear; (v) damage caused by operating the Product outside the permitted or intended uses by RYSE, namely motorizing compatible window coverings; (vi) damage caused by acts of God, other forces beyond our reasonable control, including Internet or power outages, wars, riots, terrorism, labour disputes, earthquakes, floods or other events of “force majeure”; (vii) consumable parts, such as replaceable batteries, unless failure has occurred due to a defect in materials or workmanship of the Product itself.
This Limited Warranty applies only to hardware Products manufactured by or for RYSE that can be identified by the "RYSE" trade name, or logo affixed to them. This Limited Warranty does not apply to any software, even if packaged or sold with RYSE hardware. RYSE does not warrant that the operation of the Product will be uninterrupted or error-free.
THIS LIMITED WARRANTY DOES NOT EXTEND OR APPLY TO THE WINDOW COVERING TO WHICH THE PRODUCT IS INSTALLED OR USED ON.
All costs related to the installation and reinstallation of the Product covered by this Limited Warranty are not the responsibility of RYSE. RYSE will not be responsible for any consequential damages during the following installation procedures.
The Limited Warranty extends only to the person or entity that originally purchased the Product from RYSE or from one of its authorized resellers or distributors. This Limited Warranty is not transferable. This Limited Warranty is only applicable to the Product purchased and delivered to the end-user or purchaser within the United States of America or Canada.
4. Disclaimer of Warranties
TO THE EXTENT PERMITTED BY LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. RYSE DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, RYSE LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT RYSE’ OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED ABOVE. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.
5. Limitation of Damages
IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER RYSE NOR ITS SUPPLIERS SHALL BE RESPONSIBLE OR LIABLE WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT OR TERMS OR CONDITIONS RELATED THERETO UNDER ANY BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY (A) FOR LOSS OR INACCURACY OF DATA OR COST OF PROCUREMENT OF SUBSTITUTE GOODS, SERVICES OR TECHNOLOGY, OR (B) FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO BUSINESS INTERRUPTION, LOSS OF REVENUES AND LOSS OF PROFITS. THE FOREGOING SHALL APPLY EVEN IF RYSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RYSE’ AGGREGATE CUMULATIVE LIABILITY HEREUNDER SHALL NOT EXCEED THE ORIGINAL PURCHASE PRICE PAID FOR THE PRODUCT THAT CAUSED SUCH DAMAGE. CERTAIN STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE EXCLUSIONS SET FORTH ABOVE MAY NOT APPLY TO YOU.
6. Your Rights and This Limited Warranty
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY BY STATE, COUNTRY, OR PROVINCE. THE DISCLAIMERS, EXCLUSIONS, AND LIMITATIONS OF LIABILITY UNDER THIS LIMITED WARRANTY WILL NOT APPLY TO THE EXTENT PROHIBITED BY APPLICABLE LAW. FOR A FULL DESCRIPTION OF YOUR LEGAL RIGHTS YOU SHOULD REFER TO THE LAWS APPLICABLE IN YOUR STATE, COUNTRY, OR PROVINCE.
